Child Protection & CAS Proceedings

Representing parents at all stages of Children's Aid Society investigations and protection proceedings — advocating for your rights while keeping your children's wellbeing at the centre.

Children's Aid Society (CAS) Involvement

When a Children's Aid Society opens a file on your family, the stakes are immediately high. CAS has broad powers under the Child, Youth and Family Services Act, 2017 to investigate, apprehend children, and bring protection proceedings. Getting legal advice early — including before speaking extensively with a CAS worker — is important.

Protection Proceedings

If CAS believes a child is in need of protection, they can bring proceedings seeking supervision orders, temporary wardship, or permanent wardship. We represent parents at every stage — from the first appearance through to trial.

The Child's Best Interests

In all protection proceedings, the primary consideration is the best interests, protection, and well-being of the child. We help parents demonstrate their genuine commitment to their children's safety and wellbeing — which is always the most persuasive position.

Access During Protection Proceedings

Even when a child is in CAS care, parents typically retain the right to access. Courts are required to consider access in protection proceedings, and we advocate for meaningful, appropriate access arrangements where it serves the child's interests.

Supervision Orders & Safety Plans

Courts often prefer less intrusive outcomes, such as supervision orders or safety plans. We work with families to develop credible, workable safety plans that CAS and courts will accept.

You have the right to a lawyer. If you cannot afford a lawyer for CAS proceedings, Legal Aid Ontario may cover your costs. Contact us to assess your eligibility and options.
