Divorce in Ontario

Divorce in Canada is governed by the federal Divorce Act. To obtain a divorce, you must have been separated for at least one year — or in cases of adultery or physical/mental cruelty, sooner. Our firm handles both contested and uncontested divorces.

Contested vs. Uncontested Divorce

An uncontested divorce occurs when both parties agree on all issues — parenting, support, and property — before going to court. A contested divorce involves disputes that must be resolved through negotiation, case conferences, motions, or trial. We appear at all stages of contested family proceedings.

Separation Agreements

A separation agreement is a legally binding contract that sets out how you and your spouse have agreed to divide assets and debts, determine support obligations, and arrange parenting time and decision-making responsibility. Common-Law Relationships

Common-law spouses in Ontario do not have automatic rights to property equalization under the Family Law Act. However, common-law partners may have claims based on unjust enrichment or constructive trust. Support obligations can also apply. We advise common-law clients on all available avenues.

Divorce Involving Domestic Violence

When a marriage has involved abuse, the divorce process must be handled carefully. Mediation or collaborative processes may not be appropriate. We know how to protect survivors through litigation, ensuring that control does not continue through legal proceedings.
